Holder ‘gun safety’ plea belies true ‘common sense reforms’

There are those who believe that until Eric Holder comes clean on exactly what he knew and when he knew it about Operation Fast and Furious, particularly in light of having been informed of Border Patrol Brian Terry’s murder the night that it happened and then testifying he hadn’t even heard of the operation until a few weeks before May of the following year, the bracelets he ought to be most concerned about are the dumb kind, that don’t recognize their user and that operate with a key.

Republicans in the House are not acting because they know that Obama has a stack of pardons a foot tall, ready and waiting for his signature on January 19th, 2017.

With that prospect waiting, I wouldn't want to blow it by charging anybody with a crime just yet either.

I think their plan is to not charge anybody while Obama can issue a pardon. If this is their strategy, I hope it works. If they keep everything they are working on real vague, Obama won't know who to pardon for what.

We'll just have to wait and see how successful they are at rounding up the rats after Barry is out of office.

IMO, Error Holderpos has been public enemy number one since his first day with the BO administration. There is only one way to deal with EH and those like him and the day for such is fast approaching. It ain't gunna be purty.

The only 'key' Eric Holder needs to worry about, is the one that will lock his sorry ass in a prison cell. If our congress wasn't so divided and corrupt, he'd already be there. The flaming POS!

I think you give them far too much credit. They are cowards in the face of opposition,they are backsliders and bereft of ideas and the fortitude to enact necessary change. They are no less traitors than their leftist counterparts.

I should know better and not need to ask, but can the president pardon someone if they've not been charged? "Here's a pardon for anything you might have done while I was in office?" And are presidential pardons good for state level crimes, or only federal?

Holder should be jailed, along with his boss and their associates, pending their trial for treason, after which they should swing from ropes.

Legally, Presidential pardons are not good for State crimes.

That being said, how much of what our President does is legal nowadays? A Dem governor would probably follow-up a Presidential request for pardon if he felt it wouldn't hurt him too bad or he was otherwise incentivised.

And yes, the Pardon power is generally assumed to hold for crimes that haven't been charged yet:

"In 1866, the Supreme Court ruled in Ex parte Garland that the pardon power "extends to every offence known to the law, and may be exercised at any time after its commission, either before legal proceedings are taken, or during their pendency, or after conviction and judgment." (In that case, a former Confederate senator successfully petitioned the court to uphold a pardon that prevented him from being disbarred.) Generally speaking, once an act has been committed, the president can issue a pardon at any time—regardless of whether charges have even been filed."

Thus, President Ford pre-emptively pardoned Nixon for any crimes that he might have been considered in the future to have been committed.

The president can't issue a pardon for an impeachment, a state crime, or a civil matter.
